1. Introduction

Welcome to Mendoza Wine Club LLC (hereinafter referred to as "Mendoza Wine Club," "we," "us," or "our"). These Terms and Conditions govern your use of our website and services. By accessing our website or booking our services, you agree to be bound by these terms. Please read them carefully before making any reservation.

2. Service Description

Mendoza Wine Club provides private wine tour experiences in Mendoza, Argentina. Our tour packages include:

  • Private transportation in air-conditioned vehicles
  • English-speaking professional guide
  • Winery visits and wine tastings
  • Gourmet lunches and/or dinners as specified in your tour itinerary
  • Airport and hotel transfers as included in your package

Important: Mendoza Wine Club does not book, arrange, or provide accommodation services. We are a wine tour operator only. Any accommodation arrangements are the sole responsibility of the guest.

3. Booking and Reservations

To secure your reservation, the following process applies:

  • A non-refundable deposit of 25% of the total tour cost is required at the time of booking.
  • The remaining balance (75%) is due no later than 14 days before your scheduled tour date.
  • Bookings made within 14 days of the tour date require full payment at the time of reservation.
  • You will receive a booking confirmation via email within 24 hours of receiving your deposit.
  • Your reservation is not confirmed until we have received and processed your deposit payment.

4. Pricing and Payment

All prices are quoted and payable in United States Dollars (USD).

  • All-Inclusive Pricing: Our quoted prices include all applicable taxes, fees, and service charges. There are no hidden costs or additional fees.
  • Accepted Payment Methods: We accept major credit cards (Visa, Mastercard, American Express), bank wire transfers, and PayPal.
  • Credit Card Processing: Payments are processed securely through our payment provider. Your card will be charged in USD.
  • Price Guarantee: Once your booking is confirmed with a deposit, the quoted price is guaranteed and will not change.

5. Cancellation and Refund Policy

All cancellation requests must be submitted in writing via email. The following cancellation fees apply based on when we receive your written notice:

  • 30 or more days before tour date: Full refund minus the 25% non-refundable deposit.
  • 14 to 29 days before tour date: 50% refund of the total amount paid.
  • Less than 14 days before tour date: No refund. The full tour cost is forfeited.
  • No-show: No refund will be issued for guests who fail to appear for their scheduled tour.

Refunds will be processed within 14 business days and returned to the original payment method. We strongly recommend purchasing travel insurance to protect against unforeseen cancellations.

6. Changes to Bookings

We understand plans can change. The following policies apply to booking modifications:

  • 14 or more days before tour date: Changes to dates, times, or tour details may be made at no additional charge, subject to availability.
  • Less than 14 days before tour date: Modifications are not permitted. Any changes will be treated as a cancellation and rebooking, subject to our cancellation policy and current pricing.
  • Availability: All modifications are subject to availability of guides, vehicles, and winery reservations.
  • Price Adjustments: If your modification results in a higher-priced tour, you will be responsible for the difference. No refunds are provided for modifications resulting in a lower-priced tour.

7. Tour Conduct and Responsibilities

To ensure an enjoyable experience for all guests, we require the following:

  • Responsible Alcohol Consumption: Guests are expected to drink responsibly. We reserve the right to refuse service or terminate a tour without refund if a guest's behavior becomes disruptive or unsafe due to intoxication.
  • Punctuality: Please be ready at the designated pickup location at the scheduled time. Tours will depart as scheduled. Refunds are not provided for late arrivals or missed pickups.
  • Dress Code: Smart casual attire is recommended for winery visits. Some wineries may refuse entry to guests wearing inappropriate clothing (e.g., beachwear, flip-flops).
  • Respectful Behavior: Guests must behave respectfully toward guides, drivers, winery staff, and fellow guests at all times.
  • Right to Refuse Service: We reserve the right to refuse service to anyone who, in our judgment, poses a risk to the safety or enjoyment of others.

8. Health and Safety

Your health and safety are important. Please note the following:

  • Travel Insurance: We strongly recommend that all guests purchase comprehensive travel insurance covering trip cancellation, medical emergencies, and personal liability.
  • Dietary Requirements: Please inform us of any dietary restrictions, food allergies, or medical conditions at the time of booking. We will do our best to accommodate your needs, but cannot guarantee all requests can be met.
  • Physical Requirements: Some tours involve walking on uneven surfaces, vineyard terrain, and stairs. Please advise us of any mobility concerns so we can recommend suitable tours.
  • Medical Conditions: Guests are responsible for ensuring they are fit to travel and participate in wine tasting activities. If you have any health conditions that may be affected by alcohol consumption, please consult your physician before booking.

9. Alcohol and Wine Tasting Acknowledgment

BY BOOKING A TOUR WITH MENDOZA WINE CLUB, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  • You confirm that you are of legal drinking age (18 years or older in Argentina).
  • Your participation in wine tasting activities is entirely voluntary.
  • You understand that consuming alcohol may impair your judgment, coordination, and physical abilities.
  • You are solely responsible for monitoring your alcohol intake and its effects on your person.
  • You will not hold Mendoza Wine Club, its guides, drivers, or any third-party service providers responsible for any consequences resulting from your alcohol consumption.
  • If you choose not to consume alcohol, non-alcoholic alternatives are available upon request.

10. Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY. BY BOOKING A TOUR, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING RISKS:

Travel and tourism activities involve inherent risks that cannot be eliminated. By participating in our tours, you acknowledge that you are aware of and voluntarily assume all risks associated with:

  • Motor vehicle travel on public and private roads
  • Walking on uneven terrain, including vineyards, cellars, and winery grounds
  • Consumption of alcohol and its effects
  • Exposure to varying weather conditions
  • Interactions with third-party service providers
  • General travel in a foreign country

YOU PARTICIPATE IN ALL TOUR ACTIVITIES ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability

THIS IS AN IMPORTANT SECTION THAT LIMITS OUR LIABILITY. PLEASE READ CAREFULLY.

Role as Intermediary: Mendoza Wine Club acts solely as an intermediary and booking agent. All tour services, including but not limited to transportation, winery visits, wine tastings, meals, and transfers, are provided by independent third-party service providers. These providers operate under their own terms, conditions, and insurance policies.

TO THE FULLEST EXTENT PERMITTED BY LAW, MENDOZA WINE CLUB, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any death, bodily injury, illness, damage, loss, accident, delay, or irregularity that may occur during your tour
  • Any acts, omissions, negligence, or defaults of any third-party service providers, including but not limited to transportation companies, wineries, restaurants, and their employees
  • Any loss or damage to personal property, including luggage, electronics, or valuables
  • Any delays, cancellations, or changes caused by weather, road conditions, mechanical failure, civil unrest, natural disasters, government actions, or any other circumstances beyond our reasonable control (force majeure)
  • Any consequential, special, incidental, or punitive damages of any kind

IN THE EVENT THAT LIABILITY IS ESTABLISHED AGAINST MENDOZA WINE CLUB DESPITE THE FOREGOING, OUR TOTAL LIABILITY SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR YOUR TOUR. THIS CAP APPLIES TO ALL CLAIMS IN THE AGGREGATE.

Exclusions: Nothing in these Terms and Conditions shall limit or exclude our liability for gross negligence, willful misconduct, or fraud by Mendoza Wine Club, or any other liability that cannot be excluded or limited by applicable law.

12. Release and Waiver

BY BOOKING A TOUR WITH MENDOZA WINE CLUB, YOU AGREE TO THE FOLLOWING:

You, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge Mendoza Wine Club LLC, its owners, officers, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during or as a result of your participation in any tour or related activity.

This release includes, but is not limited to, claims arising from the negligence of Mendoza Wine Club or any third-party service provider, and claims arising from participation in wine tasting activities.

Exclusions: This release and waiver does not apply to claims arising from gross negligence, willful misconduct, or fraud by Mendoza Wine Club, or any liability that cannot be waived under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mendoza Wine Club LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your breach of these Terms and Conditions
  • Your violation of any law or the rights of any third party
  • Your conduct during any tour, including but not limited to any injury or damage caused by your actions or intoxication
  • Any claims by third parties arising from your participation in tour activities

14. Third-Party Service Providers

Our tours utilize the services of independent third-party providers, including but not limited to:

  • Transportation companies and drivers
  • Wineries and wine estates
  • Restaurants and catering services
  • Local guides and experts

These providers are independent contractors and are not employees or agents of Mendoza Wine Club. Each provider is solely responsible for their own services, safety standards, and any claims arising from their operations. By booking a tour, you acknowledge that any claims for injury, damage, or loss must be directed to the responsible service provider.

15. Force Majeure

Mendoza Wine Club shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, earthquakes, floods, or volcanic activity
  • War, terrorism, civil unrest, or political instability
  • Government actions, travel restrictions, or border closures
  • Epidemics, pandemics, or public health emergencies
  • Strikes, labor disputes, or transportation failures
  • Any other circumstances beyond our reasonable control

In such events, we will make reasonable efforts to offer alternative arrangements or reschedule your tour. If the tour cannot be rescheduled, you will receive a credit for a future tour or a refund minus any non-recoverable costs already incurred.

16. Intellectual Property

All content on the Mendoza Wine Club website, including but not limited to text, images, graphics, logos, and design elements, is the property of Mendoza Wine Club LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written consent.

Photographs and videos taken during your tour may be used by Mendoza Wine Club for promotional purposes unless you notify us in writing that you do not wish to be photographed.

17. Third-Party Links

Our website may contain links to third-party websites, including wineries, hotels, restaurants, and travel resources. These links are provided for your convenience only. Mendoza Wine Club does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Your use of any linked website is at your own risk.

18. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms and Conditions or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

19. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Mendoza Wine Club regarding your use of our services. Any prior agreements, understandings, or representations are superseded by these Terms and Conditions.

21. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of our services after any changes indicates your acceptance of the new terms.
